Information we collect

When you submit a contact or intake form on this site, we collect the information you provide, such as your name, email address, phone number, and business details. We do not collect payment information through this website.

If you join The Canopy, our membership, your member account is created on Circle, the platform that hosts the membership, and your payment is processed by Stripe. Circle and Stripe collect the information needed to create your account and process your payment, including your name, email address, and payment details. We do not store your card details.

We may also collect basic analytics data (pages visited, time on site, referring URL) through third-party analytics tools. This data is aggregated and not linked to any individual.

How we use your information

We use the information you submit solely to respond to your inquiry, schedule calls, and onboard you as a client. We do not sell, rent, or share your information with third parties for marketing purposes.

Third-party tools

Our site uses third-party services including form providers and scheduling software. The Canopy membership runs on Circle, and membership payments are processed by Stripe. These services have their own privacy policies that govern how they handle your data. We encourage you to review them.

Data retention

We retain contact and intake information for as long as it is reasonably necessary to provide services or respond to your inquiry. You may request deletion of your information at any time by contacting us.

Use of this site

This website is provided for informational purposes only. You may not use this site for any unlawful purpose or in a way that could damage, disable, or impair our services.

The Canopy membership

The Canopy is a membership sold as an annual or monthly subscription. It is hosted on Circle, and payments are processed by Stripe. Your membership renews automatically at the end of each billing period, yearly or monthly, until you cancel. You can cancel at any time from your account. Cancelling stops future charges, and your access continues through the end of the period you have already paid for. Payments are non-refundable, and we do not offer prorated refunds for unused time. Circle’s own terms of service also apply to your use of the member community.

Member content and license

Everything inside The Canopy, including the video lessons, the prompt cheat sheet, the starter workspaces, session recordings, starter prompts, use cases, bonus tools, and the skills and prompts in The Tool Shed, is the property of Canopy Creative Consulting LLC or its licensors. A membership is for one person. It gives you, the member, a personal, non-transferable license to use that content in your own work and business for as long as your membership is active. One membership does not cover a team or a company, and logins may not be shared. You may not copy or distribute member content to others, or resell, repackage, publish, or teach it as your own, whether for free or for a fee. What you build with it is yours: the workspaces, documents, and outputs you create from our prompts and skills for your own business belong to you. If a membership is used in breach of these terms, we may end it without a refund.

Intellectual property

All content on this site, including text, design, graphics, and logos, is the property of Canopy Creative Consulting LLC and may not be reproduced or distributed without our written permission.

Third-party links

This site may contain links to external websites. We are not responsible for the content or practices of those sites and provide links for convenience only.

Limitation of liability

To the fullest extent permitted by law, Canopy Creative Consulting LLC shall not be liable for any damages arising from your use of, or inability to use, this website or its content.

Changes to these terms

We may update these terms at any time. Continued use of the site after changes are posted constitutes your acceptance of the updated terms.

Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions.

Participation

Applications are reviewed by our team, and we may approve, decline, or remove any affiliate at our discretion. You do not need to be a current member to apply, and participation is free.

Commission

Affiliates earn a 20% commission on the first membership payment of each new member of The Canopy they refer, whether that member chooses annual or monthly billing. Renewal payments do not generate commission, and no other products or services are eligible.

Referrals

Referrals are recorded by name. When someone you referred joins The Canopy, send us their name and the email address they joined with, within 30 days of their purchase, and we confirm the membership on our side. Purchases reported after that window, purchases we cannot match to a referral, and purchases made by affiliates on their own accounts do not earn commission.

Payouts

We review each recorded commission before approving it. Approved commissions are paid quarterly through PayPal to the payout email we have on file. Commissions tied to refunded, disputed, or charged-back purchases are reversed, including after payout, in which case the amount is deducted from the next payment.

Tax forms

If your total earnings reach the level where federal tax reporting applies, we will notify you and provide a Form W-9 or the applicable equivalent to complete. You never need to track this or submit a form on your own, since we will always reach out first. Payouts that require a completed form are held until we receive it. If we do not receive the completed form within 60 days of our request, the held commissions are forfeited.

Promotion standards

When you recommend The Canopy as an affiliate you must clearly disclose that you earn a commission, consistent with FTC guidance. Affiliates may not make earnings or outcome claims on our behalf, may not run paid ads on our brand name, and may not present themselves as Canopy Creative Co.

Changes and termination

We may update these terms or close the program at any time, with notice sent to the email on file. Commissions approved before a change or closure will still be paid under the terms in effect when they were earned.
